Iraqi Constitutional Court draws a painful blow to al - Abadi approve the return of the three vice - president of the republic , despite some of them implicated in corruption cases

BAGHDAD (AP) - Iraq's Federal Supreme Court issued a ruling Monday overturned the decision of the Prime Minister Haider al-Abadi the abolition of the posts of Vice President of the Republic, for violating the country's constitution which requires the existence of these positions.

Abadi issued on the ninth of August 2015, he spent a decision to sack the Vice President of the Republic, who were three on that date they Iyad Allawi and Nouri al-Maliki and Osama al.

And the transfer of an official statement issued Monday, Judge Abdul Sattar Bayraktar, spokesman for the federal judiciary, "The presence of one or more Deputy President of the Republic oblige stipulated by the Constitution."

He added that the "Cancel position of vice president means amending the provisions of the Constitution of the Republic of Iraq for the year 2005," adding that "Article 142 of the Constitution requires in such a case, the consent of the absolute majority of the members of the House of Representatives on the amendment and present it to the people for a referendum."

Bayraktar said, "Accordingly, and based on the provisions of Article 93 of the Constitution First, the Federal Supreme Court ruled unconstitutional the decision of (...) Cancel posts of Vice-President of the Republic."

Court decision does not mean that there will be three deputies, in the next stage, as far as confirmation to bind the existence of this position.

The Iraqi Council of Representatives approved two days after al-Abadi's decision, without amending the Constitution as it was supposed to.

And he gave Osama Najafi in November 2015, an appeal before the courts decision.

For his part, Sabri Saad spokesman said Ebadi's office in a statement to AFP that "the Federal Court has the powers to decide and their rulings are final in the interpretation and make decisions, and we deal realistically with this matter, and we respect the court's decisions."

He said that "the motive of the cancellation of positions at the time, was to reduce expenses and compressed to the maximum extent possible in the framework of the reform of administrative system and government."

Big salaries and limited responsibilities

The three vice-presidents who are removed from office as Vice-President of the Republic are Osama Najafi, the former House speaker, and Nuri al-Maliki and Iyad Allawi, the two former prime ministers.

The occupants of these positions have big salaries and teams to ensure their protection, in exchange for limited powers and responsibilities.

The Abadi decision to cancel these positions, after protests weeks continued in Baghdad and other parts of the country, with the support of the large Shiite cleric Ayatollah Ali al-Sistani, demanding the implementation of reforms in the whole of Iraq, which suffers from poor services and the spread of corruption and control of the major political parties on the capabilities of the country.

In a first reaction, the Shiite leader Muqtada al-Sadr expressed his rejection of the court's decision, and considered it a form of corruption, according to a statement issued by his office.
